Two San Jose police officers face charges of evidence tampering

(KRON) -- Two San Jose Police Department officers have been arrested and charged with filing a false police report and tampering with evidence, authorities announced Thursday.

The arrests follow an internal police investigation into the alleged activities of officers Raydarius Surry, 29, and Destiney Thompson, 30, both residents of Gilroy. Authorities said Surry made an arrest on May 3 and listed a small baggie of suspected narcotics in his police report. The department later informed him that the baggie was never booked into evidence, according to SJPD.

“On August 12th, 2026, after being notified of the missing evidence, Officer Surry conducted a pedestrian stop involving an individual unrelated to the May 3rd case,” police wrote. “During the stop, Officer Surry found an individual in possession of a similar baggie of suspected narcotics, seized it and took no further enforcement action.”

Authorities alleged that Surry booked the baggie taken in the Aug. 12 stop into evidence under the May 3 case number. Surry never documented the Aug. 12 stop, police said.

Thompson’s alleged role in the suspected crimes involved her accessing and viewing Surry’s body-worn camera video to assist him in planning the replacement of the missing evidence, according to SJPD. Police said Surry and Thompson are in a relationship.

The Santa Clara County District Attorney’s Office filed charges against the officer couple Wednesday afternoon. Both Surry and Thompson surrendered to police that evening.

“Falsifying evidence or police reports is a crime, and our Department moved swiftly to remove both officers from duty and pursue criminal accountability,” said SJPD Chief Paul Joseph in a statement. “These allegations, if proven to be true, constitute a failure to live up to the standards our community has a right to expect. I will not tolerate any Department member violating the sacred trust placed in us.”

Surry has served in the San Jose Police Department for eight years. Thompson served for six years. The case was referred to the California Commission on Peace Officer Standards and Training for temporary decertification review amid the criminal investigation.

In a subsequent update, SJPD added that, "As part of the investigation, a thorough review of both officer's cases, arrests and evidence bookings has been completed. The Department did not discover any other discrepancies or similar actions by the two officers."
